  2. Bill of Lading (for freight services)

  3. Service-specific policy

  4. These Master Terms

If a conflict exists, the higher document in this hierarchy shall control.

9. General Disclaimers

All services and Website content are provided “AS IS” and “AS AVAILABLE.” We make no representations or warranties regarding:

  • Accuracy

  • Completeness

  • Reliability

  • Availability

  • Suitability for a particular purpose

 

10. Limitation of Liability

To the fullest extent permitted by law:

Blue Pill Enterprise shall not be liable for indirect, incidental, consequential, special, or punitive damages.

 

Total liability shall not exceed:

  • The amount paid for the specific service giving rise to the claim.

 

11. Force Majeure

We are not liable for delays or failures resulting from events beyond our reasonable control, including but not limited to:

  • Acts of God

  • Weather events

  • Natural disasters

  • Governmental actions

  • Fuel shortages

  • Labor disputes

  • Civil unrest

  • Supply chain interruptions

  • Mechanical failures

  • Carrier delays

  • Pandemics

 

Performance obligations shall be suspended for the duration of such events.

12. Freight Transportation & Logistics

Freight services are governed by:

  • The Freight Hauling Service Policy & Terms

  • The applicable Bill of Lading

 

For interstate shipments, liability may be governed by the Carmack Amendment, which may preempt state law.

Shippers are responsible for:

  • Accurate weight

  • Proper classification

  • Accurate hazardous materials declarations

 

Liability limitations stated in the Bill of Lading shall control.

 

13. Notary Public Services

Notary services are provided in accordance with Florida Statutes Chapter 117.

 

Requirements include:

  • Valid government-issued identification

  • No blank spaces in documents

  • No provision of legal advice

We reserve the right to refuse notarization if:

  • Proper identification is not provided

  • Signer appears under duress

  • Signer lacks competency

  • Document violates Florida law

 

Travel fees are separate from statutory notarial fees.

 

Liability for notarial acts is limited to the cost of the notarial act performed.

14. Business Consultation Services

Initial consultations are informational and do not establish a professional advisory relationship. No financial, legal, or tax advice is provided during the free discovery session.

 

Following consultation:

  • Estimates will be delivered within 48 hours

  • Estimates are valid for 15 days

 

Work begins only after:

  • Signed SLA

  • Required deposit received

 

We do not guarantee specific financial or operational outcomes. All proprietary materials remain property of Blue Pill Enterprise unless otherwise stated in writing.

 

15. Payment, Deposits & Refunds

Deposits may be non-refundable as outlined in:

  • Refund Policy

  • Individual Service Agreements

  • SLAs

 

Refund eligibility is governed by the Refund Policy incorporated herein.

 

16. Indemnification

You agree to indemnify and hold harmless Blue Pill Enterprise from claims, damages, losses, liabilities, and expenses arising from:

  • Your misuse of services

  • Violation of these Terms

  • Misrepresentation of shipment or documentation

 

17. Binding Arbitration & Waiver of Jury Trial

ALL DISPUTES arising from or relating to:

  • The Website

  • Freight services

  • Notary services

  • Business consultations

  • Sponsorship campaigns

  • Any related agreements

Shall be resolved exclusively through binding arbitration in the State of Florida. Arbitration shall be conducted under the rules of the American Arbitration Association. YOU WAIVE THE RIGHT TO A JURY TRIAL.

CLASS ACTION WAIVER:
All claims must be brought individually. No class, collective, or representative actions are permitted. The Company may seek injunctive relief in court to protect intellectual property or confidential information.

 

18. Governing Law

These Terms shall be governed by the laws of the State of Florida, except where federal law preempts state law (including interstate

freight matters).

 

19. Severability

If any provision is deemed unenforceable, the remainder shall remain in full force and effect.
