Freight Hauling Service Policy & Terms

Definitions / Scope of Services
“Interstate Shipment” means transportation of goods that crosses one or more state boundaries and is subject to federal transportation regulations.
“Intrastate Shipment” means transportation of goods wholly within a single state and governed by that state’s laws.
1. Booking, Scheduling & Cancellations

Rate Confirmation: All hauls require a signed Rate Confirmation and a formal Service Level Agreement (SLA) before dispatch.

Loading/Unloading: Standard windows are established at booking. Delays beyond the agreed-upon window are subject to detention fees.

Cancellations (TONU): Cancellations made within 24 hours of the scheduled pickup will incur a "Truck Ordered Not Used" (TONU) fee, as detailed in your specific Service Estimate.
2. Specialized Cargo & Florida Compliance

Agricultural Inspections: In accordance with Florida law, all units (including empty Reefers) must stop at Florida Department of Agriculture Inspection Stations. Client acknowledges that transit times may be affected by these mandatory stops.

Hazmat & Tanker: Clients must provide all necessary manifests and Safety Data Sheets (SDS) prior to pickup. We reserve the right to refuse undocumented or improperly packaged hazardous materials.

Refrigerated (Reefer): Temperature requirements must be provided in writing. We maintain strict monitoring to ensure cold chain integrity.
3. Florida Intrastate Operations

Hours of Service (HOS): For all hauls occurring strictly within Florida, Blue Pill Enterprise operates under Florida Intrastate HOS regulations (12 hours driving / 16 hours on-duty).

Weight & Markings: All loads must comply with Florida legal weight limits. Our vehicles display the required "USDOT [Number] FL" markings for intrastate identification.
4. Liability, Insurance & Liens

Insurance Minimums: We maintain Florida-mandated liability coverage based on Gross Vehicle Weight (GVW), including PIP and PDL protections.

Cargo Claims: Loss or damage claims must be noted on the Bill of Lading (BOL) at the time of delivery and reported within 24 hours.

Carrier’s Lien: Pursuant to Florida Statute § 677.307, Blue Pill Enterprise maintains a legal lien on all freight in its possession for transport, storage, and detention charges. Goods will not be released until all undisputed charges are settled.
5. Payment, Detention & Layover

Invoicing: Invoices are issued upon receipt of a signed Proof of Delivery (POD). Payment terms are Net 30 unless a "QuickPay" agreement is signed.

Detention: After the first two hours of waiting at a facility, a per-hour detention fee applies.

Layover: If a driver is required to stay overnight due to facility delays, a flat layover fee will be charged to the client.
Interstate and Federal Compliance:
When providing freight transportation services that cross state lines, you acknowledge and agree that such services are subject to applicable federal transportation laws and regulations (including, without limitation, the Carmack Amendment and U.S. Department of Transportation / Federal Motor Carrier Safety Administration requirements), in addition to any state laws.
To the extent federal law preempts state law regarding liability, carrier obligations, or transportation standards, such federal law shall control
Carmack Amendment (found in U.S. Code § 14706)
Liability for Loss or Damage:
For all interstate shipments, liability for loss, damage, or delay to cargo will be governed by the terms of the applicable Bill of Lading, federal transportation law (including the Carmack Amendment), and any other governing tariff or regulatory requirements. If there is a conflict between this Policy and federal transportation law, the federal law will control.
Operational Compliance:
All transportation services provided will comply with applicable federal and state licensing, registration, and safety regulations, including but not limited to the requirements of the Federal Motor Carrier Safety Administration (FMCSA) and U.S. Department of Transportation (DOT) standards where applicable.
"Florida Addendum" Clause:
Florida Compliance: All services performed within the State of Florida are subject to Florida Intrastate Hours of Service (12 hours driving / 16 hours on-duty). Client acknowledges that all loads (especially Reefer units) are subject to mandatory Florida Department of Agriculture inspections. Pursuant to Florida Statute § 677.307, Blue Pill Enterprise maintains a lien on all freight in its possession until all freight, storage, and detention charges are paid in full.
